These website Terms tell you the terms on which you may use of our Website.

1.    Definitions

In the context of these Terms, the following words shall have the following meanings:

“We”, “us” and “St George’s Hospital Charity” refers to St George’s Hospital Charity which is registered as a charity in England and Wales (registered charity no. 1171195) with its registered office at St George's Hospital, Blackshaw Road, London SW17 0QT.

"Website" means www.stgeorgeshospitalcharity.org.uk and all associated web pages.

"Material" means all of the information, data, text, graphics, links or computer code published on, contained within or available on the Website.

"Terms" means these terms and conditions of use as updated from time to time under clause 2.3.

"User" and “you” means the individual, firm, company or organisation accessing or using the Website, registering for any events and/or making any donations.

2.    Applicable terms and conditions

2.1 The Website is owned by St George’s Hospital Charity and any use made of the Website (including registering with us, making donations and placing orders for goods or services), is subject to these Terms.

2.2 By using our Website, you confirm that you accept these Terms and that you agree to comply with them. Please therefore read these Terms carefully. We recommend that you print off a copy for future reference. If you do not agree to these Terms, then you must not use the Website.

2.3 We may, at our sole discretion, modify or revise these Terms at any time without notice by updating the text of this page.

3. Use of the Website

Anyone is entitled to view any non-password protected parts of the Website and to use for their own purposes the information contained therein, provided:

3.1.1 it is used for information purposes only, for personal use only and not for reproduction on any other website and/or for commercial gain;

3.1.2 any links created to the Website are notified to and approved by St George’s Hospital Charity before they are created;

3.1.3 no part of the Website is copied, stored in a retrieval system, or transmitted in any form or by any means to any third party without the written permission of St George’s Hospital Charity.

3.2 If you reproduce, copy, or link to our Website in breach of these Terms, your right to use our Website will cease immediately, and you must, at our discretion, return or destroy any copies and remove any links.

 

4. Ownership of intellectual property rights

4.1 We are the owner or licensee or all intellectual property rights in our Website, and in the Material published on it. Intellectual property rights means rights such as: copyright, trade marks, domain names, design rights, database rights, patents and all intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We and our licensors reserve all of our and their rights in any intellectual property rights in connection with these Terms.  This means, for example, that we and they remain owners of them and free to use them as we and they see fit.

4.2 Nothing in these Terms grants you any legal rights in the Website other than as necessary to enable you to access the Website. You agree not to adjust, to try to circumvent or to delete any notices contained on the Website (including any intellectual property notices), in particular in any digital rights or other security technology embedded or contained within the Website.

4.2 The names and logos of St George’s Hospital Charity and all related product and service names, designs marks and slogans are the trade names, service marks or trademarks of St George’s Hospital Charity and may not be used without the prior consent of St George’s Hospital Charity.

5. Material on the Website

5.1 The Website is intended to provide general information only and, as such, should not be considered as a substitute for advice covering any specific situation. Users should seek appropriate advice before taking or refraining from taking any action in reliance on any Material.

5.2 Whilst we have taken every precaution in compiling the Website, neither we nor any contributors to the Website can be held responsible for any action (or the lack thereof) taken by any person or organisation wherever they shall be based, as a result, direct or otherwise, of Material.

5.3 We may update our Website and may change the content at any time. However, please note that the Material may be out of date at any time and we are under no obligation to update it. We do not guarantee that our Website, or any Material on it, will be free from errors or omissions, nor do we represent or warrant that the Material, or will be fit or suitable for any purpose.

6. Access to the Website

6.1 We do not guarantee that our Website, or any Material displayed on it, will always be available or be uninterrupted. Access to our Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Website without notice. We will not be liable to you if for any reason our Website is unavailable at any time or for any period.

6.2 You are responsible for making all arrangements necessary for you to have access to our Website. You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of these Terms, and that they comply with them.

7. Limitation of liability

7.1 Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

7.2 To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether express or implied.

7.3 Except for any legal responsibility that we cannot exclude in law or arising under applicable laws relating to the protection of your personal information, we will not be liable for any:

 7.3.1 losses that:

(a) were not foreseeable to you and us when these Terms were formed; or

(b) that were not caused by any breach on our part;

7.3.2 business losses; and

7.3.3 losses to non-consumers.

8. Third party websites

8.1 The Website may contain links or references to websites operated by parties other than St George’s Hospital Charity. Such links are provided for your convenience only. St George’s Hospital Charity does not control such websites, and is not responsible for their content. St George’s Hospital Charity’s inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators.

8.2 Your use of a third party website may be governed by the terms and conditions of that third party site. We will not be liable for any loss or damage that may arise from your use of them. You are solely responsible for evaluating the accuracy and completeness of any information contained on the third party websites, and also the value and integrity of any goods and services offered by such websites.

10. Viruses

10.1 St George's Hospital Charity does not guarantee that our Website will be secure or free from bugs or viruses and no liability is accepted for damage caused through the downloading of viruses. You are responsible for configuring your information technology, computer programmes and platform to access our Website and having your own virus protection software.

10.2 You must not misuse our Website by knowingly introducing viruses or other malicious material or attempt to gain unlawful access to our Website. You must not attack our Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website will cease immediately.

12. Restricting funds

If you have indicated that you would like your online donation to go to one our restricted funds (which you can do by following a link from one of the fund pages on our Website or ticking a box in an applicable fund form), it will be allocated to the fund you have selected to be directed to the relevant area of the hospital.

 13. Processing refunds

13.1 Please note that charities (including St George's Hospital Charity) are only legally permitted to return donations in very limited circumstances e.g. where the donor lacks mental capacity. We therefore ask that you take care when entering your details when making a donation via our Website (using PayPal or, when setting up a direct debit, JustGiving), as we may be unable to provide any refund once your payment has been processed. We do not charge a fee for processing refunds.

14. Security

While we try to make sure that the Website is secure, and take care in the selection of third party payment processors, please note that the security of information transmitted via the internet cannot be guaranteed. Any loss incurred or sustained by any user who transmits information by means of e-mail or other internet links shall be borne solely and exclusively by such user and in no event shall any such loss in whole or part be borne by St George’s Hospital Charity or its agents.

15. Events beyond our control

St George’s Hospital Charity shall not be liable to you for any loss or damage which may be suffered by you due to any breach of these Terms caused by any event beyond its reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.

16. General

16.1 If any provisions of these Terms are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected.

16.2 No one other than a party to these Terms has any right to enforce any of these Terms.

16.3 Any failure of St George’s Hospital Charity to exercise or enforce any of its rights under these Terms shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement or any such rights.

17. Disputes

17.1 We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with us please contact us as soon as possible.

17.2 The Terms and the use by the user of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these terms and conditions.

LONDON MARATHON Terms and Conditions 

1. Participation

1.1 I agree to pay a non-refundable and non-transferable registration fee of £75 and understand that my place is not confirmed until this has been paid to St George’s Hospital Charity.

1.2 I will inform the fundraising team immediately if I have to withdraw from or cancel my place due to injury or other serious circumstances.  

1.3 I agree that if I withdraw for any reason prior to the event, any monies raised will be non-refundable and will be treated as a donation to St George’s Hospital Charity. I will make donors aware of what happens to their donations if I fail to complete the event.   

1.4 I understand that if I withdraw for any reason prior to the event, St George’s Hospital Charity cannot guarantee to grant me a place in future events.  

1.5 I understand that St George’s Hospital Charity reserves the right to revoke my event place in exceptional circumstances. 

1.6 I understand that this event is organised by the event organiser who is solely responsible for the conduct and operation of the event, including all health and safety requirements. I understand that my participation in the event is conditional upon the event organiser’s terms and conditions. 

1.7 I understand that St George’s Hospital Charity is not responsible for the event and accepts no liability whatsoever in relation to my participation in it St George’s Hospital Charity cannot be held responsible for any changes made by London Marathon Events, including date changes, cancellation, or route alterations. 

1.8 In the case of event cancellation, you will be expected to continue with fundraising activities where appropriate, and all funds raised will be retained by the charity.  

1.9 I understand that St George’s Hospital Charity will contact me by phone, email and post to provide everything I need for my chosen event, including fundraising tips and advice, useful updates about the event and training support. 

1.10 I confirm that I will be at least the minimum age required by the event organiser at the date of the event. 

1.11 You are responsible for your own training, health, and safety. You participate in the event at your own risk. 
 

2. Fundraising Activity

2.1 I agree to raise the minimum sponsorship amount of £3,000 (excluding gift aid) for St George’s Hospital Charity by the fundraising deadline, which is 6 weeks after the event date. 

2.2 I will only use lawful means to fundraise and will not do anything that is likely to bring St George’s Hospital Charity into disrepute. 

2.3 If any funds intended for the charity are raised and paid to me, I will pay it directly to St George’s Hospital Charity through the payment methods they suggest. 

2.4 I will abide by the Fundraising Regulator’s Code of Fundraising Practice 

2.5 I will show the charity any material bearing the St George’s Hospital Charity name or logo, or that discusses the work of the organisation, prior to printing and distribution.  

3. Personal Data and Images

3.1 I give permission for the free use of my first name, picture, image, feedback and comments in any future fundraising materials and/or promotion conducted by St George’s Hospital Charity. 

3.2 I give permission for my personal information to be stored and used by St George’s Hospital Charity in connection with the organisation and administration of the Event and passed to the Event organisers as required. I understand that St George’s Hospital Charity will process my data in accordance with their Privacy Policy.

CHALLENGE EVENTS TERMS AND CONDITIONS

1. Participation

1.1 A non-refundable and non-transferable registration fee is required to secure a place.

1.2 I will notify St George’s Hospital Charity promptly if I need to withdraw.

1.3 If I withdraw before the event, any donations raised will be treated as charitable contributions and are non-refundable.

1.4 Withdrawing may affect my eligibility for future events.

1.5 St George’s Hospital Charity reserves the right to revoke my place in exceptional circumstances.

1.6 I acknowledge that the event is run by an external organiser responsible for event safety and conditions.

1.7 St George’s Hospital Charity is not liable for the event or my participation.

1.8 I consent to being contacted with relevant event and fundraising information.

1.9 I confirm I meet the minimum age requirement set by the event organiser

2. Fundraising Activity

2.1 I agree to raise the minimum sponsorship target by the stated deadline (8 weeks post-event, excluding Gift Aid).

2.2 I understand that between 60-80% of my fundraising target must be raised at least 6 weeks before the event to confirm my place in the challenge. This requirement may vary depending on the event’s cost and specific timelines.

2.3 I will fundraise legally and respectfully, upholding the charity’s reputation.

2.4 Any funds received personally for the charity will be transferred using approved methods.

2.5 Any materials using the charity’s name or logo will be approved by the charity before use.

3. Personal Data and Images

3.1 I consent to the use of my name, image, and feedback in charity-related promotions.

3.2 I consent to the storage and use of my personal data for event administration, in line with the charity’s Privacy Policy.
